Auction terms
and bidder rules.
These rules explain how to register, place a bid and pay for a design lot on YAGODESIGN. Read the lot description and these terms before bidding. Lot 001 is currently a preview; bidding will start only after its schedule and full sale details are published.
Effective: 28 September 2026
1. Operator and contact
The seller and auction operator is YAGODESIGN GROUP Sp. z o.o., ul. Gdańska 7/5, 59-700 Bolesławiec, Poland, KRS 0001034229, VAT ID PL6121881439. Contact us at info@yagodesign.eu. More details are in the Impressum.
These terms supplement the general website terms. If a lot description provides more specific information about that lot, it governs the commercial details; statutory consumer rights always apply.
2. What is being auctioned
Each lot page must identify the design or service offered, the rights the winner will receive, any file formats and adaptation work included, delivery method and timing, starting price, minimum increase, currency, start and end times, and any material technical limitations before bidding opens. Illustrations and vehicle renders show a design concept; the vehicle, printing, materials and installation are included only if the lot description expressly says so.
Lot 001 shows an existing Toyota GR livery design. Its licence scope, deliverables and tax treatment must be confirmed on its lot page before the first bid can be accepted. Until then, the page is a preview and no sale is offered. A winning bid never transfers copyright, exclusivity, use on further vehicles, or rights to third-party marks unless expressly stated in the lot description and a written agreement.
3. Eligibility and verification
You must be at least 18, provide accurate account information, verify your email address, complete the Stripe Identity check and add a valid payment method through Stripe before bidding. You may bid for a business only if authorised to bind it. One person must not operate multiple bidder accounts to manipulate prices.
Stripe collects the identity document and selfie in its hosted verification flow. We receive the verification result and identifiers needed to operate the account. We do not store identity documents, selfie images or full card numbers in this website's database. See our privacy policy and Stripe's privacy notice.
Verification and a saved card do not reserve a lot and do not charge you. If verification fails or your account is restricted, contact us for a review. We may block bidding for suspected fraud, misuse or a legal requirement and will explain the decision where lawful.
4. Auction schedule and bids
Start and closing times are shown on the lot page in UTC. A bid is accepted only when our server records it while the auction is open. Your browser clock and the time you click are not decisive. The opening bid is the displayed starting price; after the first bid, each new bid must meet the displayed minimum, which is the leading bid plus the stated increment. You cannot raise your own leading bid. Automatic proxy bidding is not offered.
Before confirming a bid, review the exact amount, lot description and terms. A confirmed bid is a binding offer to buy the stated lot if it remains the highest valid bid at closing, subject to applicable consumer rights. We show the current leading amount and total number of bids, without publishing bidders' identities. An accepted bid cannot be withdrawn merely because you change your mind; contact us promptly if you made a clear input error. We will assess it fairly before closing.
The highest valid recorded bid at the published closing time wins, unless the auction is lawfully cancelled for a material technical fault or fraud. There is no automatic extension of the closing time. We do not accept bids by email or telephone.
5. Price and payment
Bids are in euro. The winning bid is the amount charged at Stripe Checkout; we do not add a buyer's premium or silently add a card charge. Any applicable tax treatment and unavoidable charges must be clear on the lot page before bidding opens. An estimated value is only an estimate and is never a sale price.
Adding a card for bidder approval does not authorise us to debit it for a bid. After the auction closes, the winning bidder must actively open the separate Stripe Checkout page and approve payment. We send confirmation and fulfil the lot only after payment is confirmed. If you cannot pay, contact us promptly; after a reasonable written opportunity to resolve the issue, we may exercise our rights under applicable law. We do not automatically award the lot to another bidder.
6. Delivery and intellectual property
Delivery is digital unless the lot description expressly states otherwise. The lot description must specify what files or licence are supplied and when. Adaptation to a different vehicle, print production and installation are separate services unless expressly included. Any licence starts only after full payment and is limited to the use stated in the lot description or a separate written licence. YAGODESIGN retains all rights not expressly granted.
Vehicle manufacturer and sponsor names or logos belong to their respective owners. The winner is responsible for obtaining permissions for third-party marks and for checking road, race-series and advertising rules before using or printing a design.
7. Consumer withdrawal
A consumer who contracts with us at a distance generally has 14 days to withdraw without giving a reason. This is an online auction: the exception for an auction that consumers may attend in person does not automatically apply. The period normally starts when the service or digital-content contract is concluded. To withdraw, email an unambiguous statement to info@yagodesign.eu or write to our address above before the period ends. We will refund payments due under law, normally by the same payment method, within the statutory period.
We will not treat participation in the auction, placing a bid or paying as consent to lose the withdrawal right. If an exception for immediately supplied digital content or a fully performed service may apply, we will first seek the separate express consent and acknowledgements required by law and provide the required confirmation. Without that process, the statutory right remains. Consumer rights concerning non-conforming digital content or services are unaffected.
8. Faults, disputes and complaints
If a material system error, unlawful bidding or fraud makes a result unreliable, we may suspend the auction, reject affected bids or cancel it, and notify affected bidders. We will not use this power merely because the price is lower than expected. We cannot guarantee uninterrupted access; if the service fails materially during bidding, contact us immediately with the lot and time of the issue.
Send complaints, withdrawal notices and requests about a design or payment to info@yagodesign.eu or the postal address in section 1. Describe the lot, account email and issue; do not email identity documents or card numbers. We will respond as required by applicable law. These terms do not limit statutory remedies or liability that cannot lawfully be excluded.
9. Personal data and changes
We process account, verification status, bid and payment-reference data to operate the auction, prevent abuse and meet legal obligations. Details, retention criteria, recipients and your rights are in our privacy policy. We may amend these terms for future auctions by publishing an updated dated version. The rules and lot details presented when an auction opens govern that auction; material changes during a live auction require notice and may require cancellation and a fresh start.
10. Applicable law
Polish law applies, without depriving consumers of mandatory protection under the law of their habitual residence where applicable. Consumer disputes are heard by courts competent under mandatory law. For business bidders, the court competent for our registered office has jurisdiction to the extent permitted by law. You may also seek help from a competent consumer dispute resolution body; see the European Commission's list.
